Indemnification

The Purchaser hereby agrees to the following:

The Purchaser shall at all times install the Diamond Hurricane Screens in strict compliance with the installation instructions set forth on this website under the heading Installation Instructions.

To the fullest extent permitted by law, the Purchaser shall indemnify fully and hold harmless Barrier Island Shutters, LLC, the manufacturer, and their parent and affiliated companies, agents, employees, and legal representatives (collectively known as indemnitees) from and against, any claims, damages, losses and expenses, demands, suits, judgments, settlements, attorney fees, other costs of defense or any other liabilities whether arising in equity, common law or statute, including all negligence, simple or gross, sole or joint, strict, contractual, comparative, or concurrent, relating in any way to bodily injury, sickness, disease or death and/or injury to or destruction of tangible real or personal property including the loss of use, resulting which arises out of, is attributable to, or is directly or indirectly connected to the Purchaser's installation of the Diamond Hurricane Screen.  Purchaser's obligation to indemnify includes, without limitation, all claims, demands, causes of action, suits, judgments, attorney fees or other costs of defense and other liabilities including, without limitation, any alleged breach of any implied or express warranty, any tort theory, and any or all other basis or supposed basis of tort liability.
